A Palmersheim & Mathew team led by Robert Palmersheim and Bill Strom secured a complete summary judgment for our client, the National Association of Postal Supervisors (NAPS), in a decision issuing from the U.S. District Court for the Northern District of Illinois on March 31, 2022. The case concerned allegations of professional negligence brought by a former postal supervisor in her administrative appeal of her termination from US Postal Service employment against NAPS and its non-attorney administrative advocates. In addition to awarding judgment as a matter of law to NAPS, the court’s carefully-reasoned decision mooted the plaintiff’s ongoing demands for more discovery that was both time-consuming and, at best, tangential to the case. Adopting Palmersheim and Strom’s language, the court noted that the “[p]laintiff’s fate before the [administrative board] was sealed on the basis of her own undisputed conduct.”
The case is captioned Montgomery v. National Association of Postal Supervisors et al., Case No. 1:15-cv-10840 (N.D. Ill.).
