Palmersheim & Mathew LLP Win Second Circuit Appeal in High-Stakes Aluminum Antitrust Litigation

Palmersheim & Mathew LLP partners Robert J. Palmersheim and Anand C. Mathew successfully appealed the dismissal of their clients’ claims by the Southern District of New York to the Second Circuit and obtained a complete reversal of the lower court decision.

Their clients, Reynolds Consumer Products and Southwire Company alleged a group of financial services and warehouse companies conspired with each other to artificially inflate prices in the aluminum market. Reynolds and Southwire, two large aluminum purchasers, opted out of existing class action and filed their own antitrust suit along with other claims.

In 2016, the Southern District of New York dismissed their claims finding no antitrust standing.

Palmersheim and Mathew appealed the dismissal, and in August 2019, The United States Court of Appeals for the Second Circuit vacated the dismissal in its entirety – a complete victory for Reynolds and Southwire in the appellate court.
